Divorce and Separation
In order to obtain a divorce you need to have been married for a minimum of 12 months in a legal marriage ceremony either here or abroad. Either you or your spouse needs to be domiciled here, or habitually resident here. You will also need to show that your marriage has irretrievably broken down.
To obtain a divorce you need to prove one of the following facts:-
- Your spouse has committed adultery
- Your spouse has behaved in such a way that it is unreasonable to expect you to continue living together with them.
- You have lived separately and apart continuously for 2 years and your spouse agrees to a divorce.
- You have lived separately and apart for 5 years.
- Your spouse has deserted you for a continuous period of 2 years.
